Calling it premature, Attorney General Lori Swanson and Gov. Mark Dayton have asked the Supreme Court to dismiss a lawsuit filed by four Republican legislators earlier this week that seeks to bar the District Court from intervening in plans for the state government shutdown.
Monday, the four legislators filed a brief arguing that the lower courts can not authorize spending on core government services in the event of a shutdown. Doing so would be a violation of the states constitution, the legislators argue. But in a dismissal request filed this morning, Swanson pointed out that the lower courts havent begun to work yet on the Governors request. The only action the Governor has taken is requesting the appointment of a special mediator if the state government does shut down July 1.
